A Simpler Way To Get Through Family Law Issues

When you work with me, Carly D. Brown, Esq., on a family law dispute, I will guide you through the mediation process with compassion and legal acumen. From the initial consultation, we will determine the best way forward and how to reach a fair and acceptable agreement.

I believe in being fair and using the mediation process to the full extent. This means I will never just write a legal agreement for a couple – it truly needs to be an agreement between the two parties.

Additionally, if you are not fairly treated in the agreement or discussions, or if you do not have the capacity to understand or protect your interests, I will recommend you get your own attorney, and I'm happy to make a referral. My role as mediator is to make sure both parties have their best interests and rights represented.

What To Expect From My Services

My mediation practice offers couples professional guidance through the divorce process in a supportive and amicable manner; it typically coincides with an uncontested divorce. As opposed to a contested divorce and litigation, which often leads to tension and conflict, my services can help you separate and transition into a new relationship more peacefully.

In addition to the cooperative and supportive nature of mediation, numerous other benefits can be found:

  • More cost-efficient than the traditional contested divorce process
  • Less negative impact on each person and on any children involved
  • More individualized agreement at the conclusion
  • Less time-consuming than contested and litigated divorce
  • More control of the decisions made throughout the separation and/or divorce

By choosing to participate in mediation, you and your spouse are committing to work through this difficult process together with the guidance of a professional.

I can help mediate most family law issues, including:

  • Child custody and visitation arrangements
  • Divorce cases
  • Child support creation or modifications
  • Establishing spousal maintenance

Additionally, I can help with the equitable distribution of assets, such as your primary residence, budget, business aspects, liabilities, debts, retirement funds and more.

Unsure If Mediation Is Right For You?

If you or your spouse is on the fence about using mediation, I am available to answer your questions. The worst-case scenario is that you spend time on the phone during a free consultation or you spend an hour with me to see if I can help you come to some agreement.

If you choose not to move forward with the mediation process, you will only have paid one professional for just one hour of their time, instead of both parties paying two different attorneys. Attorneys often charge several thousands of dollars just for an initial consultation and a retainer.

The best-case scenario is that you and your partner come to my office for one hour and learn during that meeting that you can participate in this process and get all the legal information you need to make informed decisions that  will help you come to an agreement without the necessity of hiring two separate adversarial attorneys. Many clients find this a useful, highly beneficial option instead of spending money for separate attorneys and allowing the fight to drag on for hours and hours of billable time.

I Am Here For You Now And Down The Road

I can also assist you with follow up items from the mediation or tasks down the road. Many issues come to light after the divorce is final, such as changing your will or making other legal updates. I am able to help you with these items, or I can offer you a lawyer referral to help you.

I am pleased to serve New York residents in Williamsville and the surrounding cities. If you are considering divorce or a legal solution for a conflict, I am a certified mediator with nearly 10 years of experience in divorce mediation.
